Massachusetts General Laws c. 94G, Section 13(c) states: “No person shall consume marijuana in a public place or smoke marijuana where smoking tobacco is prohibited.” Section 13(d) also prohibits an open container of marijuana or marijuana products in a vehicle’s passenger area on a way or place open to the public.
The Massachusetts Cannabis Control Commission confirms that adult use is legal for people 21 and older, but legal retail access does not override public-use rules or private-property policies. The Commission’s visitor guidance also says not to drive impaired and not to transport cannabis across state lines, by plane or through the mail.
